Welcome to SimplyPermits. If you continue to use this website (including but not limited to browsing or creating an account) you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern SimplyPermits’ relationship with you in relation to this website (www.simplypermits.com) and the SimplyPermits digital permitting service (*.simplypermits.com).

The term “SimplyPermits” (“us”, “we”, or “our”) refers to the owner and operator of this website. The term “digital permitting service” or “service” refers to the permitting application owned and operated by SimplyPermits. The term “you” or “your” refers to the user or viewer of our website.

The use of this website and service is subject to the following terms of use:

Accounts and Communications

By creating an account on our website or service you acknowledge that you are at least 18 years of age, and agree to subscribe to automatic notifications pertaining to your account, purchases, and digital parking permits.

You represent and warrant that the information you supply is accurate, true, and complete. The use of any information or materials on this website and service is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure and update that information available through this website and digital permitting service are accurate, true, and complete.

If we suspect any information to be incomplete, inaccurate, or illegal we reserve the right to refuse, cancel, or edit the account and any related services.

Purchases and Subscriptions

If you purchase through our service you may be asked to supply relevant information to the purchase. This information may include but is not limited to personal information (phone number, home address, unit number, email address), vehicle information (year, make, model, vin), and credit card information (credit card number, expiration date, CVC).

By purchasing through our service you represent and warrant that you are legally authorized to use such credit card or payment method, and that information related to the purchase or service is accurate, true, and complete.

The service employs third parties for the completion of payments and purchases. By submitting a transaction you grant us the right to provide the information to the third parties subject to our Privacy Policy.

In many cases our digital permitting service bills on a subscription (“Subscription(s)”, or “Recurring”, or “Reoccurring”) basis. The billing cycle is defined during the checkout process and at the end of the billing cycle your subscription will renew automatically until cancelled.

You may cancel a subscription anytime in your online dashboard, or by contacting a SimplyPermits support agent.

A valid payment method is required to process your purchase through our service. If such payment method fails for any reason you authorize us to attempt to reprocess the automatic renewal up to 5 times over 7 days.

If your payment fails after the final renewal attempt, your digital permit will be marked as inactive and may be unauthorized to park in the lot or location until a new permit is successfully purchased.

We reserve the right to refuse or cancel your service for reasons including but not limited to:

  • Permit or service availability
  • Inaccurate pricing or descriptions
  • Incomplete or invalid information submitted (including user information, vehicle information, or billing information)
  • If we suspect an order of fraud or illegal activity

You are responsible for maintaining and updating permit information and payment methods in your account.

Refunds

Except where required by law, all transactions and subscriptions are non-refundable.

Limitation of Liability

Neither SimplyPermits nor any of its officers, directors, managers, principals, stockholders, partners, members, employees, agents, or representatives (each a “Related Party” and, collectively, the “Related Parties”) shall be liable for any loss, liability, data, intangible losses, or expense arising out of or in connection with the performance of any services contemplated by this Agreement, unless such loss, liability, damage or expense shall be proven to result directly from the willful misconduct of such person. In no event will the SimplyPermits or any of its Related Parties be liable for special, indirect, punitive or consequential damages, including, without limitation, loss of profits or lost business, even if you have been advised of the possibility of such damages. Under no circumstances will the liability of SimplyPermits and Related Parties exceed, in the aggregate, the fees actually paid to SimplyPermits hereunder.
