If you continue to use this website (including but not limited to browsing or creating an account) you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern SimplyPermits’ relationship with you in relation to this website (www.simplypermits.com) and the SimplyPermits digital permitting service (*.simplypermits.com).

The term “SimplyPermits” (“us”, “we”, or “our”) refers to the owner and operator of this website. The term “digital permitting service” or “service” refers to the permitting application owned and operated by SimplyPermits. The term “you” or “your” refers to the user or viewer of our website.

The use of this website and service is subject to the following terms of use:

Accounts and Communications

By creating an account on our website or service you acknowledge that you are at least 18 years of age, and agree to subscribe to automatic notifications pertaining to your account, purchases, and digital parking permits.

You represent and warrant that the information you supply is accurate, true, and complete. The use of any information or materials on this website and service is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure and update that information available through this website and digital permitting service are accurate, true, and complete.

If we suspect any information to be incomplete, inaccurate, or illegal we reserve the right to refuse, cancel, or edit the account and any related services.

Purchases and Subscriptions

When you purchase through our service, you may be asked to supply relevant information for the purchase. This information may include, but is not limited to, personal information (e.g., phone number, home address, unit number, email address), vehicle information (e.g., year, make, model, VIN), and payment information (e.g., credit card number, expiration date, CVV).

By purchasing through our service, you represent and warrant that you:

  • Are legally authorized to use the provided payment method.
  • Will ensure all information provided, including vehicle details and payment information, is accurate, true, and complete at all times.

Our service employs third parties for the completion of payments and purchases. By submitting a transaction, you grant us the right to provide the necessary information to these third parties as outlined in our Privacy Policy.

Our digital permitting service often bills on a subscription (“Subscription(s)”) basis. Subscriptions automatically renew at the end of each billing cycle unless canceled by the user. The billing cycle is defined during the checkout process.

User Responsibilities:

  • Cancellation: Users are solely responsible for canceling subscriptions or permits before the renewal date to avoid charges. Cancellations must be completed via the online dashboard or by contacting a SimplyPermits support agent at least 5 business days before the renewal date.
  • Permit and Payment Management: Users must maintain and update permit, vehicle, and payment information in their account. SimplyPermits is not responsible for any issues arising from user failure to update this information.
  • Failed Payments: If a payment method fails for any reason on a permit renewal, you authorize us to reattempt processing up to 5 times over 7 days. If payment is not successfully processed after these attempts, your permit will be marked as inactive, and you may be unauthorized to park in the designated location until a new permit is purchased.

SimplyPermits reserves the right to refuse or cancel your service for reasons including, but not limited to:

  • Permit or service availability.
  • Inaccurate pricing or descriptions.
  • Incomplete or invalid information submitted (e.g., user details, vehicle information, billing details).
  • Suspected fraud or illegal activity.

Dispute Waiver:

By using our service, you waive your right to dispute charges based on your failure to cancel, update permit or payment details, or any other user-related oversight.

Refunds

All transactions and subscriptions are final and non-refundable, except where required by law.

  • No refunds will be issued for failure to cancel on time, failure to update account details, or any other user-related errors.
  • Users acknowledge that charges are non-disputable once processed, except in cases of verified fraud or unauthorized transactions.

Limitation of Liability

Neither SimplyPermits nor any of its officers, directors, managers, principals, stockholders, partners, members, employees, agents, or representatives (each a “Related Party” and, collectively, the “Related Parties”) shall be liable for any loss, liability, data, intangible losses, or expense arising out of or in connection with the performance of any services contemplated by this Agreement, unless such loss, liability, damage or expense shall be proven to result directly from the willful misconduct of such person. In no event will the SimplyPermits or any of its Related Parties be liable for special, indirect, punitive or consequential damages, including, without limitation, loss of profits or lost business, even if you have been advised of the possibility of such damages. Under no circumstances will the liability of SimplyPermits and Related Parties exceed, in the aggregate, the fees actually paid to SimplyPermits hereunder.
